UPSC Students Drowning Case transfers to CBI
New Delhi: The Delhi High Court has taken a serious decision in relation to the three UPSC students who died in Delhi coaching center basement due to drowning and the case has been handed over to the CBI. The ruling is made to guarantee the society a credible investigation since the occurrence is a grave issue, which may imply corruption by some civil servants.
The court was peculiarly concerned with neutrality of the investigation, so it stated: “In view of the nature of the incident and to ensure that the public does not have any doubts for the investigation of this case, this court transfers the case to the CBI.” This opinion also shows that the court has a desire to bring its decision in line with the expectations of the population.

The court observed that integrity of officials have eroded and what is even more shocking is that MCD officials have no regard for the lives of common people. The bench snapped back: “Fortunately, you have not challaned rain water for privileged interference into the basement, the way you have arrested the SUV driver for privileged driving of his car into that basement.”
Allegations of Police Complicity
A petitioner’s counsel raised allegations of police complicity in the incident, highlighting the involvement of a nearby police chowki. The MCD’s lawyer mentioned that actions had been taken against everyone except the Rau Coaching Centre, as it is considered a case property. The court questioned the MCD commissioner, emphasizing the importance of their actions in restoring public trust.
The court inquired whether desilting had been performed and asked the Deputy Commissioner of Police (DCP) if the investigating officer had collected maps of the area’s water drains. The DCP responded that a notice had been issued to MCD officials regarding the matter.
The court was informed that the drainage system in the area where the incident occurred was nearly nonexistent, with roads functioning as makeshift drains. The high court expressed concern that punishing the innocent while allowing the true culprits to go free would be a grave injustice.
Call for Accountability and Scientific Investigation
The court directed the Delhi Police to provide a clear account of the facts, warning that failure to do so would be unacceptable and likening it to a “brothers club” approach. The high court criticized public authorities for their lack of effectiveness, stating, “The public authorities aren’t working these days.” The court emphasized that no one is above the law and that even those in positions of power must be held accountable.
Furthermore, the high court advised the Delhi Police to conduct the investigation scientifically and to resist any external pressures. This directive aims to ensure a thorough and impartial investigation that leaves no room for doubt or manipulation.
